Billing issues with ex-Simpli customers

For all ex-Simpli customers please let us know if you are still getting billed from Simpli. There has been much confusion Simpli has caused regarding this issue. This blog entry will make it clear to our customers and to Simpli.
It appears that Simpli and Erica Douglass have an unusual way to consider the close date of our contract. Any customer with a hosting due date (not when Simpli decided to charge the invoice) before August 23rd 2006 should have been billed by Simpli. Any invoice due on or after that date should have been billed by Empowering Media. Simpli stance on the matter is not correct for many reasons:
- Unknown to us until after our final payment was paid we were told by Simpli that we have to collect on Simpli’s overdue invoices (normally accounts receivables is not something that is transferred, nor was included in the contract)
- Based upon Simpli’s interpretation of the contract they could have collected on invoices due two months in advance of the closing date. More or less allowing them unlimited time to charge customers BEFORE the closing date
- In discussion with our lawyers this is a “very perverse” way of looking at our contract and will pursue legal action if they won’t/don’t comply to the contract.
After August 23rd 2006, you are legally no longer a customer of Simpli and do not owe payment to them of invoices after that date. Any customer that has been billed for an invoice due after August 23rd 2006 by Simpli please contact your credit card provider or PayPal and request a charge back. It is very easy to do and if needed we can assist you. At the moment it appears that Simpli has credited only a few accounts and now refuses to credit any others. We will work with you regarding any late payment to us if Simpli decided to already charge your account.
